IMPORTANT NOTICE TO PARTICIPANTS:
THESE TERMS AND CONDITIONS CONSTITUTE A PART OF YOUR CONTRACT WITH HACKER PARADISE & NOMA COLLECTIVE AND, UPON ACCEPTANCE OF YOUR APPLICATION, GOVERN YOUR HACKER PARADISE POWERED BY NOMA TRIP AND PARTICIPATION IN THE HACKER PARADISE POWERED BY NOMA PROGRAM WHICH YOU ARE INVITED TO JOIN AND CONSTITUTE A BINDING CONTRACT AND TERMS AND CONDITIONS GOVERNING YOUR RIGHTS AND THE RELATIONSHIP BETWEEN YOU, NOMA COLLECTIVE AND HACKER PARADISE.

BY JOINING A HACKER PARADISE POWERED BY NOMA TRIP OR USING HACKER PARADISE & NOMA COLLECTIVE  SERVICES IN ANY MANNER YOU ARE AGREEING TO OUR WAIVER AND OUR PRIVACY POLICY. YOUR SAFETY AND THE PROTECTION OF YOUR DATA IS IMPORTANT TO US. PLEASE REVIEW OUR PRIVACY POLICY FOR MORE INFORMATION ABOUT HOW WE COLLECT, USE AND STORE DATA.

Background

Hacker Paradise, Powered by Noma are brands that market and deliver digital nomad experiences at properties around the world. Hacker Paradise, Powered by Noma handles the marketing and onsite event program. The location of your accommodation (hereinafter referred to as the “Property”) is ultimately responsible for the receipt of payment and delivery of all other elements of the experience. This includes, but is not limited to, accommodation, food and beverage services, Property facilities (e.g., pool, bar, gym), internet, cleaning, and utilities. Hacker Paradise and Noma Collective are not responsible for lost or stolen items or the actions of Property staff.

These Booking Conditions, along with any other written information we bring to your attention before confirming your booking, apply to your reservation with the Property regarding your stay. Please read them carefully as they set out our respective rights and obligations. In these Booking Conditions, references to “you” and “your” include the first named person on the booking, all persons on whose behalf a booking is made, or any other person to whom a booking is added or transferred.

Hacker Paradise and Noma Collective LLC act as marketing agents for Property bookings. When you make a booking, you are entering into a contract with the Property, not with Hacker Paradise or Noma Collective themselves. We accept no responsibility for the acts or omissions of the Property or the services provided by the Property. The Property’s terms and conditions will apply to your booking, and we advise you to read these carefully as they contain important information about your stay.

Included in Your Booking

The following are included in the room price:

  • Your accommodation at the Property
  • Access to communication with Hacker Paradise and Noma Collective staff
  • Property amenities as outlined by the Property (examples may include pool access, cleaning, gym, and bicycles)
  • Complimentary events organized as part of our community program (yoga, workshops, and certain social activities)

Extras

The following are subject to an additional fee. Please notify us in advance of booking if you have any questions:

  • Any additional guests staying with you that we are not made aware of at the time of booking. This includes those staying overnight or for a shorter duration than the total length of stay.
  • Excursions (costs will be stated in advance of booking)
  • Any spa therapies and treatments
  • All food and beverages unless otherwise stated

Fees & Service Charges

All bookings are subject to at least a 4% booking charge. The Property may have additional taxes and fees.

Internet

Hacker Paradise, Powered by Noma, makes every effort to ensure that the Property provides a stable internet connection. However, infrequent service interruptions may occur, and we cannot be held accountable for disruptions beyond our control.

In instances where there is an outage, we have local SIM cards that will get the Wi-Fi up and running quickly. It is your duty to inform us in the event of any service interruption; otherwise, we may be unable to assist.

You also warrant that you will not use the internet for any nefarious or illegal purposes.

Onsite Communication: Slack

We use Slack as the primary approach to communication onsite and email in advance and subsequent to your visit. We encourage you to use Slack to receive all communication. If you are unable to use Slack, you may not have access to event and programme information. By proceeding with your booking you acknowledge that we communicate all event information and programme activity this way and you will notify us in advance if there is any reason why you cannot access Slack.

Slack is a group messaging platform and you acknowledge that you will use it in a reasonable manner which does not offend or disrespect any other user. We reserve the right to remove you from Slack in the event of unreasonable behaviour.

Events

We provide a weekly programme of events sourced from our community and the wider local community. These events may be moved, changed, amended or cancelled. Whilst we will make every effort to deliver our programme, by booking you acknowledge that we have no duty to deliver fixed events or events of a specific nature. We actively take on board feedback as to event ideas and feedback, however, we cannot guarantee that event ideas will be taken into account.

Covid 19 Policy

Hacker Paradise and Noma Collective will abide by the rules of the country in which the Property is located. By booking, you agree to adhere to these policies. These may include vaccine and/or mask mandates.

In the event you suspect you have been exposed to Covid-19, please let the community manager know immediately and follow the local guidelines for quarantine.

Accuracy of Prices & Descriptions

Hacker Paradise and Noma Collective cannot be held liable for errors or omissions in bookings or pricing, either made by the Property, or as a result of system failure of any kind. We reserve the right to amend advertised prices at any time prior to booking. We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur. The prices offered when booking may increase due to demand and seasonality, which may affect the price of your booking if extending. We will act reasonably when resolving such issues.

Our Responsibility for Your Booking

Your contract is with the Property and its terms and conditions apply. As a marketing partner, we accept no responsibility for the actual provision of the arrangements. Our responsibilities are limited to making the booking in accordance with your instructions. We accept no responsibility for any information about the arrangements that we pass on to you in good faith.

Refunds and Dispute Resolution with Location Partners

In the event of a dispute with our location partner (e.g., accommodation provider), we will not be liable for issuing refunds until the dispute has been fully resolved. Refunds will only be processed once we have received the corresponding funds back from the location partner. We will make every reasonable effort to expedite the resolution process, but delays may occur based on the policies of the location partner involved.

Visa, Passport and Health Requirements

It is your own responsibility to ensure compliance with immigration, visa and health requirements of the country where the Property is located. Requirements may change and you are therefore strongly recommended to check the up to date information of the Passport Office, appropriate embassy or consulate or your doctor as applicable in a reasonable amount of time prior to your departure.

Cancellation Policy

Any cancellation of reservations or portions of reservations MUST be received in writing.

Bookings made prior to August 19th, 2024:

  • 60 days or more prior to arrival = The amount of the deposit made, minus 20% cancellation fee of total trip price (before discounts) + US$100 processing fee.
  • 0 – 60 days prior to arrival = No refund
  • No show = No refund
  • All shared accommodation is non-transferable

Bookings made after August 19th, 2024:

  • 90 days or more prior to arrival = The amount of the deposit made, minus 20% cancellation fee of total trip price (before discounts) + US$100 processing fee.
  • 0 – 90 days prior to arrival = No refund
  • No show = No refund
  • All shared accommodation is non-transferable

Due to the above it is HIGHLY recommended that all clients purchase “trip cancellation insurance” in order to cover a possible cancellation of 60 days or less of your itinerary.

Hacker Paradise & Noma Collective reserve the right to cancel your booking or reject a booking request based on a person’s ability to remote work or value misalignment with our strong values of community, kindness, optimism, adventure, and understanding. This is not only important to our thriving community but also to our dedicated team, who work hard to provide the best experience for everyone in our community.

Changes by You & Transfer of Booking

If you wish to change any part of your booking arrangements after the confirmation invoice has been issued, you must inform Hacker Paradise or Noma as soon as possible.

Whilst we will do our best to assist, we cannot guarantee that we will be able to meet your requested change. Where we can meet a request, all changes will be subject to any applicable rate changes or extra costs incurred. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Where we are unable to assist you and you do not wish to proceed with the original booking we will treat this as a cancellation and subject to the cancellation policy above.

If any member of your party is prevented from travelling, that person(s) may transfer their place to someone else (introduced by you and satisfying all the conditions applicable to the arrangements). If they are not able to proceed with the original booking we will treat this as a cancellation and subject to the cancellation policy above.

Room Sharing Option

For guests selecting the room-sharing option available on some of our Editions, you can coordinate with a friend to book separately, with each of you taking one bed in the shared room. If you don’t have a personally chosen roommate, a roommate will be assigned at random from others who selected this same room option. Roommates are assigned randomly, and while we strive to pair guests based on sex (male with male, female with female), there is a possibility of co-ed room assignments.

If you have any questions or preferences, feel free to discuss them with a team member during your pre-trip call.

Events Beyond Our Reasonable Control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

Special Requests

If you have any special requests (for example dietary requirements, cots or room location), please let us know at the time of booking. We will make our best good faith efforts to ensure all requests are taken into account.

Jurisdiction and Applicable Law

These Booking Conditions and any agreement to which they apply are governed in all respects by the country in which the Property is located. We both agree that any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the local governing body.

Force Majeure

Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife, terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concerned’s control.

Disabilities and Medical Problems

We are not a specialist disabled holiday company, but we will do our utmost to cater for any special requirements you may have. If you or any member of your party has any medical problem or disability which may affect your stay, please provide us with full details before you make your booking so that we can try to advise you as to the suitability of your chosen arrangements. It is your responsibility to provide us with full and accurate details on any special assistance you may require. We may require you to produce a doctor’s certificate certifying that you are fit to participate in your chosen arrangements. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details.

Your Behaviour

All guests staying with us are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of other guests. If in our opinion, or in the opinion of any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or unreasonable annoyance to any of our other guests or any third party or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your booking arrangements immediately.

In the event of such termination our liability to you and/or your party will cease and you and/or your party will be required to leave your accommodation or other service immediately. We will have no further obligations to you and/or your party. No refunds for lost accommodation or any other service will be made and we will not pay any expenses or costs incurred as a result of termination.

You and/or your party may also be required to pay for loss and/or damage caused by your actions and we will hold you and each member of your party jointly and individually liable for any damage or losses caused by you or any member of your party. Full payment for any such damage or losses must be paid directly to the Property or other supplier prior to departure. If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us as a result of your actions together with all costs we incur in pursuing any claim against you. We cannot be held responsible for the actions or behaviour of other guests or individuals who have no connection with your booking arrangements or with us.

Promotion

Promotion credits and other credits are non-refundable and expire 12 months from the date they were acquired, unless explicitly outlined in writing by Hacker Paradise and Noma Collective prior to the expiration date.

Paradise Pass Promotion

           Paradise Passes purchased in 2024

  • The Paradise Pass only applies to trips beginning in 2025. If your pass is not redeemed for a 2025 trip, it will be converted into a non-refundable credit for trips starting in 2026, in the amount equal to your Paradise Pass purchase, or the remaining balance if partially used. You will be responsible for the difference between your credit amount and the regular price of your desired 2026 trip. Any remaining credits held at the end of 2026 will expire.
  • This deal cannot be applied in conjunction with any other discounts (including members discount), promotions or referral commission.
  • If there is a discrepancy between the value of your Paradise Pass and the price of your chosen trip (trips are priced depending on destination), then:
    • The pass holder will be responsible for paying the difference in cases where the trip total is higher than the Paradise Pass value.
    • In cases where the trip total is lower, Hacker Paradise will issue a future trip credit for the difference and will not provide a cash refund.
  • Confirm your Paradise Pass destination no less than 60 days before the trip start date. If there is still a remaining balance on your Pass, it will need to be paid at this point.

           Paradise Passes purchased in 2023

    • The Paradise Pass only applies to trips beginning in 2024. If your pass is not redeemed for a 2024 trip, it will be converted into a non-refundable credit for trips starting in 2025, in the amount equal to your Paradise Pass purchase, or the remaining balance if partially used. You will be responsible for the difference between your credit amount and the regular price of your desired 2025 trip. Any remaining credits held at the end of 2025 will expire.
    • This deal cannot be applied in conjunction with any other discounts (including members discount), promotions or referral commission.
    • If there is a discrepancy between the value of your Paradise Pass and the price of your chosen trip (trips are priced depending on destination), then:
      • The pass holder will be responsible for paying the difference in cases where the trip total is higher than the Paradise Pass value.
    • Confirm your Paradise Pass destination no less than 60 days before the trip start date. If there is still a remaining balance on your Pass, it will need to be paid at this point.
    • In cases where the trip total is lower, Hacker Paradise will issue a future trip credit for the difference and will not provide a cash refund.

           Paradise Passes purchased in 2022

  • 2022 passes are non-refundable credit in the amount that you paid, usable for trips taking place in 2024. However, you will be responsible for the difference between the credit value and the regular price of your desired 2024 trip. Any remaining credits held at the end of 2024 will expire.
  • In the event that Hacker Paradise is sold or acquired by another entity, the new entity shall have sole discretion in the treatment or use of Paradise Passes.
